O luto da Maré

A noite do dia 24 e a madrugada de 25 de junho de 2013 ficarão assinaladas na memória dos moradores do complexo de favelas da Maré e da cidade do Rio de Janeiro pela tristeza.

Um grupo de agentes do Batalhão de Operações Especiais (Bope) entrou no complexo para reprimir furtos a transeuntes na avenida Brasil, via que corta a região. Logo de início, foi morto um dos policiais. A partir dali, segundo os depoimentos dos moradores registrados na investigação que se seguiu, houve uma sequência de ações brutais nas comunidades de Parque Maré, Nova Holanda e Parque União, aparentemente como forma de vingar o policial. A Maré amanheceu chorando nove moradores mortos.

A mobilização da comunidade e de instituições da Maré ajudou a impedir que houvesse ainda mais vítimas e impulsionou as investigações pela Polícia Civil, por meio da Divisão de Homicídios. Uma semana depois, uma manifestação por justiça e contra a violência policial reuniu moradores e pessoas de vários cantos da cidade, ajudando a ampliar a repercussão internacional da tragédia.

Foram necessários muitos dias para identificar as vítimas e convencer seus familiares a contribuir com depoimentos e pistas para as investigações da Divisão de Homicídios. Um número significativo de testemunhas se dispôs a vencer o medo de falar –fato incomum no contexto das favelas cariocas.

Um ano após os tristes acontecimentos, o responsável pelas investigações, o delegado Rivaldo Barbosa, informa que o trabalho será concluído em breve.

As perícias indicam que o policial morreu no confronto com integrantes de grupos locais armados. Outras oito pessoas foram decorrente de resistência seguida de morte; uma última trabalhava em um bar no momento em que a polícia, avançando para os fundos da favela Parque União, atirou na direção do estabelecimento comercial.

As informações preliminares das investigações instigam a reflexão sobre mortes em favelas e periferias e sobre o esclarecimento de crimes em nosso país. Tudo indica que oito vitimados serão caracterizados como mortos ao resistir à ação policial. Isso significa que essas pessoas serão apontadas, não como vítimas, mas como autores das próprias mortes, num contexto de confronto com a polícia.

Tramita no Congresso Nacional o projeto de lei nº 4471/2012, que propõe o fim da caracterização dos homicídios que acontecem em confronto com as polícias como “autos de resistência” seguidos de morte. Essa expressão, que se tornou corriqueira, vem servindo para justificar a falta de esclarecimentos sobre muitas ações criminosas envolvendo profissionais da segurança pública e integrantes de grupos criminosos armados. O texto do projeto sugere medidas para que tais delitos sejam, de verdade, investigados e punidos. Seria a chance de reduzir o número de processos investigativos policiais nunca esclarecidos, os quais geram impunidade, abuso de autoridade e fraudes.

A comprovação de que as mortes resultaram de vingança pelo assassinato do sargento do Bope exige atenção e resposta das autoridades. É incompreensível e inaceitável que profissionais que deveriam atuar na proteção e no respeito à vida sejam responsáveis por mortes brutais e injustificadas.

The evening of the 24th and the morning of the 25th of June, 2013 will be marked in the memory of the residents of Maré shantytown complex and the city of Rio de Janeiro by sadness.

A group of Special Operations Battalion (BOPE) agents entered the complex to curb thefts to passersby on Avenida Brasil, a road that crosses the region. Early on, one of the policemen was killed. From there, according to the testimonies of the residents registered in the investigation that ensued, there was a string of brutal actions in the communities of Parque Maré, Nova Holanda and Parque União, apparently as a means to avenge the police officers. Maré dawned crying nine dead residents.

The community’s mobilization and Maré institutions helped prevent even more victims and spurred investigations by the civil police, through the Homicide Division. A week later, a demonstration for justice and against police violence brought together locals and people from various corners of the city, helping expand international repercussions of the tragedy.

It took several days to identify the victims and convince their families to contribute with testimonies and clues for the investigation by the Homicide Division. A significant number of witnesses was willing to overcome the fear of speaking – an unusual fact in the context of Rio’s slums.

One year after the sad events, the person in charge of the investigations, delegate Rivaldo Barbosa, said that the work will be completed soon.

The investigations indicate that the policeman died in the confrontation with members of armed local groups. Eight other people were charged with resistance followed by death; and one more was working at a bar at the time the police, advancing towards the back of Parque União slum, shot towards the business establishment.

Preliminary information from investigations instigates reflection on deaths in slums and suburbs and on solving crime in our country. All indications point towards eight victims being proclaimed dead while resisting police action. This means that these people will be identified not as victims, but as authors of their own deaths in a context of confrontation with the police.

In the National Congress, the draft law No. 4471/2012 is being processed, which proposes the end of the characterization of the homicides that happen in confrontation with the police as “resistance” followed by death. This expression, which has become commonplace, has served to justify the lack of clarification on many criminal actions involving professionals of public safety and armed criminal gang members. The draft text suggests measures to ensure that such offenses are, in fact, investigated and punished. It would be a chance to reduce the number of police investigative processes never clarified, which generate impunity, abuse of authority and fraud.

Proof that the deaths were the result of revenge for the BOPE sergeant’s murder requires attention and response from the authorities. It is incomprehensible and unacceptable that professionals who should act in the protection and respect for life are responsible for brutal and unjustified killings.
